millbrae from last night. >> lawrence, you were in millbrae last night. >> i was. we go over there every year. usually the streets are just packed all the kids having a great time. last night, very few kids and ponchos. probably the most common costumes you could find out there. the rain continuing to fall this morning around the bay area but it's shifted a bit further to the south into san jose staying dry for most of halloween but now they are seeing the rain falling there. you can see those showers dragging on through. nothing really heavy, just some light rain coming through and beginning to fall apart. now, as we head through the day today, this is going to sag further south and move east so heading out of town into san jose, into milpitas, you're seeing more light early on this morning. roads are slick. so be careful. behind this we have some clearing on the back side. in fact, by the afternoon, probably turning to partly cloudy skies and just a slight chance of a few showers. overlooking san francisco now, still looking good. beautiful skies orange lights

and temperatures in the 50s and 60s this afternoon maybe low 70s in the warmest spots but we are thinking 80s in the not too distant future. we'll tell you when coming up. right now let's check the roads with elizabeth. >> we can barely see the dublin interchange roads. westbound 580 in the commute direction, you can see some headlights. overall 15 minutes between the altamont pass and the dublin- pleasanton area. this is a live look at the nimitz past the coliseum. 15 minutes between 238 and the maze. and traveling down towards milpitas, it looks okay now for silicon valley commuters. flooding around hospital curve approaching paul avenue. chp may have just cleared it. we may be seeing improvement in the southbound lanes. we were watching fender-benders earlier northbound 280 heading into san francisco.

one approaching mariposa, another one approaching cesar chavez. if there is any activity it's off to the right-hand shoulder. mass transit a great option on wet days like this. so far everything is off to a great start for bart, ace, muni, caltrain and ferries. back to you guys. >> thank you. wet weather may have played a role in an accident that injured two santa rosa young trick or treaters around 7:30 last night at north dutton avenue and west 8th street up north. police say a 10-year-old boy and 4-year-old girl were in a crosswalk slightly ahead of the parents when they were struck by a car. the drive did cooperate with the police there. -- of the driver did cooperate with the police there. the children taken to the hospital with nonlife- threatening injuries. four people treated for wounds for a shooting outside a halloween party at usc. police say two people were detained shortly after the shooting which happened last night just before midnight. the four people injured were rushed to los angeles hospitals. no word on their conditions. and not far from that shooting, three people were

injured in hollywood when shots were fired into a halloween crowd. los angeles police say three people were taken to hospitals, one of them a 17-year-old. he is critically injured with gunshot wounds to the chest and leg. at least three men were taken into custody. 5:04. investigators are looking into the death of a man shot at an oakland cell phone store last night at the metro pcs store on international boulevard. investigators think it was connected to a robbery attempt. but they are not releasing any any information about the victim or suspects. >> san francisco police are thanking people on social media for helping them catch a man accused of vandalizing a muni bus. now they are turning to the public to find two more suspects. cbs 5 reporter anne makovec is in san francisco with the bus fire caught on tape. anne. reporter: it is amazing how the cell phone has changed things. it's turned everybody into an amateur vig videographer.

it already helped them catch one alleged vandal and now police are hoping cell phone video will help them catch two arsonist. this cell phone videoed is in slow motion so you can see th faces. police released this yesterday. you can see a couple of guys throwing something burning into the muni bus. windshield is already smashed. police took some still pictures from this video of two suspects they are hoping to catch. this was taken sunday after the giants celebration when things got out of hand on market and third. police have already arrested this guy after this picture was taken by the "san francisco chronicle" published there, then widely circulated on social media sites. >> he makes the front page of the paper, you're pretty much your goose is cooked. >> reporter: now, here is that suspect's mugshot. 22-year-old gregory tyler graniss of san francisco.

sandy. this morning some new york city subways are rolling again. also today laguardia airport is re-opening. but 5 million people are still without electricity and the number of deaths blamed on sandy has passed 70. ines ferre joins us now with more on the storm from lower manhattan. ines. >> reporter: good morning, michelle. i am at the entrance of new york's fdr drive and you can see that this area is still flooded after the storm. but down at the jersey shore, that devastation is even worse. reporter: president obama visited new jersey to see firsthand the damage from super storm sandy. >> good job. >> reporter: the president and governor chris christie flew in marine one to see the devastation from above. what they saw were homes destroyed and streets still under water. president obama promised the government will do whatever it can to help storm victims. >> we will follow up to make sure that you get all the help that you need until you rebuild. >> reporter: not far away, the search for trapped or missing people on staten island continues.

nypd rescued six people from rooftops on wednesday. there are signs that life is returning to normal in new york city. all three airports are open as of today, as is the new york stock exchange and broadway shows. but problems still persist. traffic in the city is nothing short of a nightmare. without public transportation wednesday, manhattan streets were clogged with people trying to get back to work. subway and train service is starting up today on a limited basis and governor andrew cuomo has suspended fees through friday. >> i am declaring a transportation emergency. >> reporter: mayor bloomberg is mandating that all cars driving into manhattan have to at least have three people. >> i know it is inconvenience for a lot of people. but the bottom line is, the streets can only handle so much. >> reporter: officials estimate half of all gas stations in the area are closed. the result, long lines. >> hundreds of cars here trying to get some gas. >> reporter: industry analysts say it could take another week to get all the gas stations back up and running.

>> reporter: school classes are canceled again for today and tomorrow. that just poses another potential headache for working parents who have to figure out how to take care of their children during the day. >> no kidding. are there still some people who need to be rescued? >> reporter: in staten island, yes. there are two missing children and authorities are still looking for them. that was one of the zones that was supposed to be evacuated that was mandatory evacuation in that area. of course, so many people there have suffered so much and they wish that they had evacuated when authorities had told them. >> there's so much devastation we have been seeing. do we know how much longer the power will be out? >> officials are saying that for manhattan, that people may see the lights coming back on

investigators say when secuy caught on camera stealing dozens of dvds and cds, police say this woman blamed it on cancer. investigators say when security stopped the woman, she started hyperventilating, told officers she had cancer and it causes her to suffer from memory loss. police aren't sure if she is

really sick. but par medical, say she faked the hyperventilation according to paramedics. she is now facing they want charges. >> she is in trouble. >> i would say so. 5:15. let's check the roads. >> they are a little wet this morning. >> even though despite that we are not seeing huge problems because of it so despite the kind of slick conditions, traffic is moving along okay. here's a live look at light traffic towards san francisco and the bay bridge toll plaza. no metering lights. so yeah, everything looks good so far in the upper deck. we were watching it stall in the lower deck for a while approaching treasure island but it looks like that is in the clearing stages if not gone already. to our maps, watching a couple of minor fender-benders one reported near hacienda. looks like it's blocked the shot but there was another one near north livermore avenue and actually, looks like we are seeing some slowing on our sensors in that area. at last check it was cleared to the right-hand shoulder but obviously there's still some activity there in the westbound lanes of 580 approaching north livermore. your drive time is slow because

of it. 22 minutes now between the altamont pass and 680 so yeah, we have some brake lights now through the livermore area because of that accident. it's really the only one out there. otherwise here's a live look at the golden gate bridge. i just watched the lane change trucks move through a little while ago. so now we're good to go in the southbound direction heading towards san francisco. but once again, you can see this pavement is pretty slick all across the bay area. mass transit great options. so far, after that big record ridership day yesterday, bart systemwide on time. ace, muni, caltrain, ferries, everything back on a normal schedule this morning. that is a check of your "timesaver traffic." for more on this wet forecast, here's lawrence. >> yeah. a little rain around the bay area this morning. unfortunately for some of the trick or treaters showers and some folks didn't seem to mind into san francisco. the folks were out and about in those scary looking costumes. there's some ghouls out there cute little guy, yeah, walking around and trick or treating in the showers outside. took a little longer for the rain to come to san jose so it

stayed dry there but now the rain continues to fall and we'll likely continue to fall through the morning hours especially in the south bay. doppler picking up on the rainfall sliding through into the santa cruz mountains into san jose and into the livermore valley. we are seeing just some light showers but enough to make those roads slick so if you are headed out, be sure to take extra time. it is going to be wet coming into work today. out the door this morning those temperatures running in the 50s and low 60s. showers continuing but by the afternoon, likely to see a break in the rainfall just a slight chance of a couple of wandering showers toward the latter part of the day. we'll see a lot of sunshine in between the clouds and temperatures in the 60s, maybe even some low 70s in the warmest spots inland. cold front passing through this morning. one more off the coastline but high pressure is going to build in before that can move in. so i think this will be it for the rain for now as this moves by. we'll start to dry out but wet this morning and then by the afternoon we'll see warmer weather and drier conditions. computer models picking up on it pretty well as it moves the system out. by the middle of the day you can see partly cloudy skies. leftover clouds in toward the san jose area but by the

afternoon maybe even a little more sunshine there and maybe just an occasional pop-up shower and that is it. so we'll see a drying trend toward the afternoon continuing into the next couple of days. 70 livermore. 68 san jose. 65 san francisco. looking out over the next few, looks like temperatures start to warm up on saturday. by sunday maybe an offshore wind, temperatures could move back into the 80s in some of the warmer spots, guys. that continues into the first part of next week. back to you >> thank you. nurses are about to walk off the job again at several bay area hospitals. this strike set to begin at 7 a.m. will involve 3200 nurses and several hundred respiratory, x- ray and other technicians. it will affect 7 bay area sutter healthcare hospitals. some experts say these nurses are in a powerful position because they are in an industry that's quickly growing in a bad economy. >> unlike certain other areas it's not going to be outsourced to other countries. the hospital needs to be in

that geographic location. so i think all those give the workers and the union a greater ability to negotiate and to organize than we're seeing in other industries. >> these nurses have been in contract negotiations for the past 18 months. the series of strikes has forced sutter to hire temporary staff on expensive five-day contracts. a marin county teen accused of attempted murder and stealing a celebrity chef's car is back in court today. 18-year-old max wade is set to enter a plea accused of shooting at an suv last spring. he is also a suspect in the theft of guy fieri's lamborghini mavericks' open season starts next friday. 24 surfers will trying to take on the swell on the best surf day of the winter season. the season runs through march 31st. so many of us p.e. classes back in junior high and high school, they weren't too

much fun. for some it was a drag unless you go to the thomas hart middle school in pleasanton because there, they add a little rhythm to the classes a tradition that has kids loving p.e. and that's why they are this week's "cool school." reporter: 300 students atoms hart middle school are getting a crash course in swing. >> i'm sarah and i'm an 8th grader. >> i'm an 8th grader. >> i'm laura and i'm an 8th grader. >> i'm an 8th grader atoms hart middle school. >> reporter: just two of the 175 couples of 7th and 8th graders dancing in their p.e. class. over three weeks the group is down to the top dance. it's been a school tradition for a dozen years. it's a workout and a self- esteem booster. it's a win-win. >> it's really fun. i love it. >> it's incredible how skilled these kids become and it becomes very graceful. you're going to see it.

you can see on our high-def doppler radar we have some of those showers moving through right now. it's a slow mover dragging through the bay area, it stayed dry for halloween and much of the san jose area but they are getting rain now so if you are headed out to work this morning, it's going to be slick on the roads and then start to clear out toward the latter part of the day. here's the cold front moving on through on the back side still a couple of leftover clouds so it won't be entirely sunny by the afternoon but we'll get some sunny breaks and slight chance of a wandering shower. right now light rain, temperatures running into the 50s and 60s. a promise of much warmer weather on the way, maybe some 80s, can we work that out for the weekend? that would be nice. right now let's check the roads with elizabeth. >> that would be nice. after dealing with a couple of wet days. live look at livermore. we are following a couple of different problems because of the wet weather. westbound 580 approaching livermore avenue look at the brake lights. that accident involved six cars. at this point it doesn't appear to be blocking lanes but your drive time is creeping up there. nearly 25 minutes between the

altamont pass and the dublin interchange. also, slick surfaces all across the bay area and some flooding reports coming in. in fact, about 2:00 this morning, they issued a traffic advisory near hospital curve near paul avenue where it often floods when it rains. so in the southbound lanes you may still find one lane blocked because of standing water. chp is aware of it. they are working to clear that. mass transit always a great option especially on slick days like this. bart systemwide on time. ace train one looks great. muni, caltrain and ferries no problems. santa rosa police trying to determine if rain played a factor in an accident that injured two young trick or treaters last night. it happened around 7:30 yesterday evening at north dutton avenue and west 8th street. police say a 10-year-old boy and a 4-year-old girl were in a crosswalk slightly ahead of their parents when they were struck by a northbound car. the driver did cooperate and stopped and talked to police who say the kids' injuries do not appear to be life-

threatening. two men have been arrested for their halloween shootings of four people on the usc campus. usc police say two men were arguing about 11:30 last night. one of them pulled out a gun and opened fire. one man shot several times critically wounded, three bystanders wounded with nonlife- threatening injuries. none were usc students. there was another halloween shooting involved in l.a. three people taken to the hospital after shots were fired into a crowd in hollywood. one of them a 17-year-old crit chi injured with gunshot wounds to the chest and the leg. at least three men now have been taken to jail. oakland police are looking into the shooting death of a man at a cell phone store last night at a metro pcs store on international boulevard. investigators believe it was connected to a robbery attempt. but they are not releasing any information about the victim or any possible suspects. police hope the search for a vandalism suspect goes viral

after social media helped them nab a man seen smashing a muni bus window. cbs 5 reporter anne makovec joins us know. anne, it's amazing people still do this when so many have cameras. >> reporter: yeah. that's the thing. if you're going to engage in ridiculous hooliganism these days it's not the police that you need to worry, it's the guy with the cell phone because that can identify you and lead to serious felony charges. check out this cell phone video. police are now circulating it trying to identify two people who set a muni bus on fire sunday night at 12:30 a.m. on monday. thethe driver had gotten off the bus before it began. police hope someone recognizes these two and turns them in. >> we will identify you, arrest you, prosecute you and you're going to pay for it. so don't go there.

new york city is a transportation emergency. governor cuomo ordered fares for all trains, subways and buses to be waved today and tomorrow as a way to encourage people to take mass transit. commuters who would normally take the train had to walk or drive to get to work yesterday creating gridlock in manhattan. the airlines have resumed some service in and out of the northeast. the first flights landed in the bay area last night. one of the first to arrive was a united flight from jfk to sfo. passengers said it's been a stressful time in new york. >> i was staying at a hotel, the union square w. they took good care of us until the power went out. no cell phones, you couldn't call anyone. it was crazy. >> it was terrifying. we have a niece who works on wall street who takes the ferry, staten island ferry. there's no dock anymore. you see the roofs of trees everywhere. houses floating away. >> flights from the bay area have resumed departures to the east coast. bart may have a solution to the problems plaguing their

escalators at some train stations. they often break down because machinery is exposed to the weather as well as urine from san francisco's homeless people. the clip the radio station apologized. >> pretty good. >> we are ready for the election. the first of this week's two reports on jobs is just in from washington. the labor department says the number of new jobless claims is down to 363,000 this week. that's a level that indicates some modest hiring. tomorrow we'll get the employment report for october. it's the last unemployment report before voters head to the polls next tuesday to choose our next president. early estimates of losses from sandy are running between $10 billion and $20 billion with some as high as $50 billion. about half of which will be insured. >> this is a big headache now. but many homeowners are suffered losses do to flooding could find themselves out of luck. here to explain is jill schlesinger, editor at large for cbsmoneywatch.com. so how do you fine out what's covered and what's not? >> reporter: well, generally speaking, whether water damage

is covered by a homeowner policy is how it occur. standard homeowners insurance policy will cover structural and water damage only in limited circumstances. so for example, if a tree knocks a hole in your roof or breaks a window and rain pours inside, that's usually covered. but most policies do not cover damages that result from rising water. and this is bad news because many of those affected by sandy do not have coverage through the government's national flood insurance program. the only glimmer of hope here is that residents in areas declared a disaster area like new york and new jersey, could be eligible for federal assistance. that's why you saw those governors quickly get out in front and ask the president to declare it an emergency situation and a disaster area. >> right. jill what should homeowners do right now? >> reporter: well, as in any big situation you guys have had things that happen whether it's out there with earthquake or a big fire you want to locate

your homeowners insurance policy. you want to see what kind of coverage you have. amazingly, if your car was damaged you are going to need that auto policy. that's what will protect you if a tree falls on your car. next take pictures or video of the damage before you move anything. make a list of all your damage and lost items if you can include the date of perform and the value that's good. then you have to contact your insurer, make contact with the adjustor, submit that claim quickly. do not make permanent repairs until the insurance company inspects the property and you have made an agreement on the cost of repairs. by the way, don't forget here, all settlement offers from insurance companies can be negotiated. we sometimes forget about that when we're in a crazy state. on moneywatch.com, we have how to file a property insurance claim for you guys this is good thing to keep handy for the future. >> absolutely. and, you know, flood insurance i lived on a lake on the east coast and it's very expensive and you have to get it in addition to your policy. and you have to feel for some

of those folks that were half a mile inland not on the water and then, boom, here it comes. >> reporter: that's right. >> jill schlesinger, editor at large for cbsmoneywatch.com thank you. >> thank you, jill. okay. the day after halloween, the day after the big parade what's lawrence have for us? rain. >> more rain. november we're starting out wet but it looks like those showers will continue to taper off as we head throughout the day. that rain now sliding into parts of the south bay at this time. hi-def doppler showing us as it makes its way in toward the santa cruz mountains of the san jose area just some light showers right now. kind of nuisance rainfall but enough to make the ground wet heading out and a wet commute and ride to work but that's going to begin to taper off as we head into the afternoon. right now, skies are mostly cloudy, still some of the scattered showers very wet moisture make its way off the pacific. so a few clouds in the forecast for this morning. then by the afternoon, the clouds likely going to part a little bit. we'll see a little bit of sunshine, a slight chance of a wandering shower but the temperatures in the 60s maybe some low 70s inland. this cold front moving through

this morning. we have another one off the coastline. but not going to get here. high pressure going to start to build in. but before so, we have this wet start to the morning early on. then lots of sunshine beginning to make its way back into the bay area the next few days. all right. our computer models picking up on the system moving through as we head toward the middle of the day begins to break up a little bit. by 12:00, 1:00, just some partly cloudy skies. in the latter part of the afternoon maybe a pop-up shower over the mountains but we start drying things out and that will be a trend that takes us into the weekend. traveling around today, some morning showers could see some delays at sfo this morning. we'll start to break things up toward the afternoon. around the country a much better day to travel should be about 84 degrees in houston, 73 in denver, 52 degrees in chicago and 52 mostly cloudy in new york. temperatures in the 60s and low 70s inland by the afternoon today. the next couple of days return to dry weather. by the weekend, those offshore winds kick in. maybe the temperatures moving up into the 70s and 80s in many parts of the bay area. that's a look at weather. let's check traffic now with

elizabeth. >> all right. for today we still have these wet roads out there. we're watching a couple of different accidents. nothing huge. it could be worse. this is a live look at the dublin interchange. you can see that stormy conditions making it difficult to see especially those taillights heading eastbound towards livermore. westbound 580 traffic getting busy now through the dublin- pleasanton area but let's go to our maps and show what you it looks like through livermore. westbound 80 approaching livermore avenue. we have an accident. at this point it looks to be on the right-hand shoulder but we are seeing a lot of brake lights through that stretch all the way past vasco into livermore avenue. this is what it's doing to that drive time. it's because of that bottleneck in livermore. nearly a half hour between the altamont pass and the dublin interchange. past livermore the speeds improve quite a bit. mass transit nice option this morning. bart on time. ace train looks good no delays there. muni, caltrain and ferries everything is on schedule. so we'll show you a couple of live traffic cameras the slick
